A serious motorcycle accident near Jacksonville NC last week resulted in injuries to the driver and passenger on the bike.
The accident happened on NC Highway 24 between NC 172 and Piney Green Road. Apparently, the driver of the motorcycle lost control and wreck the bike. The driver and passenger suffered road rash but were expected to survive the accident.
In a serious motorcycle accident involving only the bike and injuries to its occupants, typically the only claim will be for the passenger for his or her injuries. This passenger claim would typically be made against the insurance company for the motorcycle as well as possible UIM claims against other insurance policies. Unfortunately, we have seen numerous insurance companies attempt to deny the valid claims of passengers claiming the passenger was contributorily negligent thus barring the passengers claim.
