In a serious motorcycle accident involving only the bike and injuries to its occupants, typically the only claim will be for the passenger for his or her injuries. This passenger claim would typically be made against the insurance company for the motorcycle as well as possible UIM claims against other insurance policies. Unfortunately, we have seen numerous insurance companies attempt to deny the valid claims of passengers claiming the passenger was contributorily negligent thus barring the passengers claim.
