A moped is considered a passenger vehicle and a vehicle under North Carolina law (N.C.G.S. 20-4.01). A moped is not considered a motor vehicle.
As a vehicle, a moped is entitled to the same rights of the road as a automobile or bicycle. This means that a moped has the right to use an entire lane when traveling on the roads of North Carolina and motor vehicles can only pass a moped when the law allows for passing.
